This post from the always excellent hypebot blog nicely sums up my feelings on the subject:

If indies had the option to allow their music to be available without DRM, and had the ability to compete on price (i.e. let me set my own track and album prices rather than them being set by iTunes), it would help force the hands of the majors -- assuming that's what Apple REALLY wants...

Indies /DO/ have that option, however, when you/they decide to play in the sandbox owned by Apple, then you also agree to play by their rules.

Why don't all of the indies band together, create an eCommerce site, and sell music there?

Yup, it being done on several sites - problem? Not enough traffic.

If it were me (love that phrase!) then I would burn calories trying to band together and compete with iTunes.

Surely there is a programmer/web dev out there who would be willing to create it for free, with compensation later (like $0.01 for each track sold).
 
Hey Michael! It's a good idea (and has been done by main BTW) but respect, it's an aside from the point. The point is that iTunes, as the undisputed heavyweight of music download sellers, wants to be a serious proponent on the side of good i.e. the side of non-DRMed non-arbitrary-price-fixed-music, they have an avenue they can pursue today. If they don't they don't, cool, like you say it's their sandbox. But if they don't want to fight for good, they should take off the white cape.
